01. Platform Scope & Network Operations

Horsepower Networking ("HPN", "we", "us", or "our") operates an automotive enthusiast platform, digital registry, community showcase, and partner referral hub connecting automobile owners with verified, third-party aftermarket performance facilities, tuners, and speed shops.

Independent Contractors: All partner shops, fabrication specialists, dyno tuners, and mechanics featured on Horsepower Networking operate as strictly independent businesses and third-party contractors. Horsepower Networking does not directly own, manage, or employ personnel at partner shops, nor does HPN perform mechanical wrenching, dyno tuning, or vehicle modifications directly unless expressly contracted in writing under an official HPN service tier.

02. Performance Modifications & Emissions Compliance

In accordance with the United States Clean Air Act (42 U.S.C. § 7522) and the regulations of the California Air Resources Board (CARB), any component that alters or bypasses an emissions control device is sold and intended strictly for closed-course competition, sanctioned track racing, or off-road motorsport use only.

Such components are not legal for sale or use on pollution-controlled motor vehicles operated on public streets, roads, or highways in jurisdictions requiring emissions compliance. It is the sole and exclusive responsibility of the vehicle owner and purchaser to ensure their vehicle adheres to all municipal, state, and federal emissions, noise, and safety statutes.

03. Factory Warranty Advisory

The installation of aftermarket performance parts, including forced induction systems, coilover suspension, custom engine calibrations (tunes), and track modifications, may result in the voidance or limitation of original equipment manufacturer (OEM) powertrain or bumper-to-bumper warranties.

Horsepower Networking LLC and its network partners accept no responsibility for vehicle manufacturer warranty claim rejections, denied claims by dealerships, or loss of factory warranty coverage resulting from modifications featured or referred through this platform.

04. Assumption of Risk & High-Performance Driving

High-performance motorsport, track days, dyno testing, drag racing, and the operation of high-horsepower sports cars and supercars inherently involve severe and unavoidable risks, including but not limited to: mechanical catastrophic failure, engine component stress, transmission failure, tire blowouts, fire, collision, property damage, and severe physical injury or death.

By engaging with Horsepower Networking, utilizing our partner network, or participating in community track days and gatherings, you knowingly, freely, and voluntarily assume all such risks, whether caused by vehicle stress, track conditions, or third-party actions.

05. Member Car Showcase Registry & User Media

When you submit vehicle photographs, dyno statistics, engine specifications, or modification itemizations to the Horsepower Networking Member Car Showcase (showcase.html):

• You affirm that you are the lawful owner of the vehicle or possess express authorization from the owner to publish the build details.
• You warrant that all photos and media uploaded are either original works authored by you or used with lawful license, and do not violate copyright or privacy laws.
• You grant Horsepower Networking a perpetual, royalty-free, worldwide license to display, promote, and format your build on our website, social media, and marketing communications.
• HPN reserves the right to review, edit, reject, or remove any submission that fails moderation standards, promotes reckless public driving, or includes fraudulent specifications.

06. Intellectual Property & OEM Trademark Fair Use

All third-party automotive manufacturer marks, names, and emblems referenced on this platform—including but not limited to Chevrolet®, Corvette®, Porsche®, Ford®, Mustang®, McLaren®, BMW®, Nissan®, GT-R®—are the registered trademarks of their respective copyright and trademark owners.

Their mention on Horsepower Networking is made strictly for nominative fair use to describe, categorize, and identify vehicle builds, fitments, and compatibility. Horsepower Networking LLC is an independent enthusiast network and has no direct affiliation, sponsorship, or endorsement from these automobile manufacturers.

07. Merchandise Store, Shipping, & Refunds

Merchandise orders placed through the official HPN Merch Store are fulfilled and governed pursuant to our Shipping & Returns Policy. In summary:

• Standard merchandise orders are processed within 2-4 business days.
• Unworn, unwashed apparel with original tags may be returned within 14 days of delivery.
• Special-order performance parts or custom personalized gear are non-refundable once production or ordering has commenced.

08. Limitation of Liability & Indemnification

To the maximum extent permissible under applicable law, Horsepower Networking LLC, its founders, officers, employees, and agents shall in no event be held liable for any direct, indirect, incidental, punitive, or consequential damages resulting from:

• Mechanical failures or bodily injuries occurring at track days, dyno facilities, or partner workshops.
• Decisions made based on information, tuning specs, or member builds published on this website.
• Interruption of service, data loss, unauthorized access, or payment gateway delays.

You agree to indemnify, defend, and hold harmless Horsepower Networking LLC against any third-party claims, liabilities, losses, or legal expenses arising from your breach of these terms or misuse of this platform.

09. Governing Law & Dispute Resolution

These Terms of Service and any dispute arising out of or related to this website shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any conflict of law principles. Any legal suit, action, or proceeding shall be instituted exclusively in the federal or state courts located in Harris County, Texas.
